TRADE SECRET

Projects, Commercial Proposals, Methodologies, Recipes, Formulas, Market Research are confidential information of your business and must be protected as a trade secret.

Trade secrets are intellectual property rights over confidential information that can be sold or licensed.


In general, to qualify as a trade secret, information must be:

  • Commercially valuable because it is secret;

  • Be known only to a limited group of people, and be subject to reasonable steps taken by the legitimate holder of the information to keep it secret, including the use of confidentiality agreements for business partners and employees.

  • The unauthorized acquisition, use or disclosure of such secret information in a manner contrary to the honest business practices of third parties is considered to be an unfair practice and a violation of the protection of trade secrets.
